Section 179D – Energy Efficient Commercial Buildings Deduction
Section 179D of the Internal Revenue Code provides a permanent federal tax incentive for businesses that invest in energy-efficient commercial and institutional buildings. Administered by the Internal Revenue Service (IRS), this provision allows qualifying taxpayers to claim accelerated deductions for high-performance building systems that reduce energy and power consumption.
Originally enacted as a temporary provision, Section 179D was enhanced and made permanent under recent federal legislation, creating long-term planning certainty for building owners and designers.
AARC helps clients identify, document, and maximize Section 179D deductions through engineering-backed, audit-ready studies.
What Is Section 179D?
Section 179D allows building owners and designers to claim a per-square-foot tax deduction for qualifying energy-efficient improvements, including:
- Interior lighting systems
- HVAC and hot water systems
- Building envelope (walls, roofs, insulation, windows)
The deduction applies to both new construction and retrofit projects.
Available Deduction Amounts
- Base Deduction: Starting at approximately $0.50 per square foot
- Enhanced Deduction: Up to $5.00 per square foot (with prevailing wage and apprenticeship compliance)
Because Section 179D is now permanent, these benefits can be incorporated into long-term capital planning and facility upgrade strategies.
Who Can Benefit
Private Sector Buildings:
- Commercial and industrial property owners
- Manufacturers, warehouses, data centers, offices, and hospitals
- REITs, partnerships, and corporations
Government Buildings:
For public-sector projects, the deduction may be allocated to the designer, including architects, engineers, design-build firms, and energy consultants.
